BOOKING TERMS AND CONDITIONS
Thank you for booking and/or traveling with Parlour Media, LLC, a limited-liability company existing under the laws of the State of New York (“PARLOUR”). These Terms and Conditions (the “Terms”) apply to any travel products and/or services (the “Services”) you have booked with or purchased from PARLOUR, and govern the contractual relationship between you (the “Client”) and PARLOUR with respect to any such Services.
PLEASE READ THESE TERMS CAREFULLY. BY BOOKING ANY SERVICES WITH PARLOUR, OR BY TRAVELING ON A PARLOUR-ORGANIZED TRIP, YOU ACKNOWLEDGE THAT YOU: (i) HAVE READ AND UNDERSTAND THESE TERMS, AND (ii) INDICATE YOUR EXPRESS ACCEPTANCE OF AND AGREE TO BE BOUND BY THESE TERMS.
1. THE BOOKING AGREEMENT
Your booking is confirmed and a contract exists when PARLOUR, or an authorized agent acting on PARLOUR’s behalf, has received the applicable deposit from the Client and has issued written confirmation upon receipt. Please check your confirmation carefully and report any incorrect or incomplete information to PARLOUR or its authorized agent immediately. Please ensure that names are exactly as stated in the relevant passport.
2. BOOKING ON BEHALF OF OTHERS
By booking on behalf of other travelers, you are deemed to be the designated contact person, the Client, for every traveler included on that booking. By booking on behalf of another traveler or travelers, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and PARLOUR will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
3. MEDICAL CONDITIONS
3.1 You are responsible for assessing whether traveling with PARLOUR is suitable for you. PARLOUR encourages all Clients to consult their physician to confirm their fitness for travel and participation in any planned activities. This includes soliciting a physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the Client’s travel with PARLOUR. PARLOUR does not provide medical advice. Ultimately, it is your responsibility to assess the risks and requirements of each aspect of travel based on your own unique circumstances, limitations, fitness level and medical requirements.
3.2 Pregnancy is considered a medical condition and must be disclosed to PARLOUR at the time of booking. PARLOUR may refuse to carry pregnant women over 24 weeks. PARLOUR may also refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.
3.3 Travel with PARLOUR may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit with PARLOUR varies and PARLOUR makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.
4. SPECIAL REQUIREMENTS
4.1 Any special requirements must be disclosed to PARLOUR at the time of booking. Certain Services may not be suitable for all people due to restrictions posed by limitations in mobility, physical or cognitive disability, pregnancy or various other physical or mental conditions.
4.2 PARLOUR will make reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options. While you may make special dietary and accommodation requests, such requests do not form part of these Terms or the contract between Client and PARLOUR and PARLOUR is not liable for any failure to accommodate or fulfill such requests.
5. CURRENCY, PRICES, AND SURCHARGES
5.1 Payment for all Services shall be made in United States Dollars.
5.2 The published price of the trip and any Services offered by PARLOUR is subject to change at any time, before or after booking confirmation, up to 30 days before departure. Trips are priced and advertised inclusive of applicable sales taxes.
5.3 After a confirmation has been issued, PARLOUR reserves the right to impose surcharges on any products or services booked for reasons arising from increases in transportation costs, fuel costs, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airport charges, local operator costs, currency and exchange fluctuations, increases in taxes, or government action which impacts the price of the applicable Services; provided however, PARLOUR will only do so where the increase in question is greater than 2% of the original price paid for the products or services. Upon learning of the necessity to impose a surcharge in accordance with this section PARLOUR will provide notice to you as soon as reasonably possible.
Where the increase in price is greater than 7% of the price of the applicable Service, upon receiving notification from PARLOUR you may elect to either:
(a) cancel the applicable trip/Services booking without incurring any penalty; or
(b) accept the change of price
You must notify PARLOUR of your election within 14 days of receipt of notice of the increase, or you will have been deemed to have accepted the price change and any associated liability for payment of the increase.
5.2 From time to time, PARLOUR may offer reduced pricing on certain Services. Reduced pricing applies only to new bookings. Bookings where payment of at least a deposit has been received are not entitled to reduced pricing.
5.3 All deposits are absolutely non-refundable after 24 hours for Single Occupancy bookings, and 48 hours for incomplete Double Occupancy Bookings.
6. DETAILS REQUIRED FOR BOOKING
As a condition of booking, you must provide the information requested by PARLOUR along with final payment. If you fail to provide all required information prior to the date on which full payment is due, an administrative fee will be charged for any costs incurred by PARLOUR as a result of your failure to provide the required information. In the event that you fail to supply required information, PARLOUR reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable PARLOUR, in its sole discretion. The information required by PARLOUR will vary by trip and will be communicated to you during the booking process. PARLOUR will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.
7. FINAL PAYMENT AND CHARGES
7.1 The confirmation sent by PARLOUR or its authorized agent will contain details of final payment required for any booking including amount, due date, and departure instructions. If full payment is not received by the applicable due date, PARLOUR may, at its sole discretion, change the rate payable for the booking, or treat the booking as cancelled and retain the deposit paid on booking as a cancellation fee. If a booking is made less than 60 days before the departure date, then the full amount must be paid at the time of booking. If, for any Service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking.
7.2 PARLOUR is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to PARLOUR.
8. CANCELLATION BY THE CLIENT
8.1 Cancellation terms specific to each trip and/or Services will be communicated to you prior to booking by methods including but not limited to the booking web site, an authorized agent’s booking form, or via email. You may indicate your desire to cancel your booking by notifying PARLOUR in writing. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received. Deposits and payments are non-refundable and non-transferable.
8.2 PARLOUR is not responsible for any incidental expenses or consequential losses that you may incur as a result of a cancelled booking such as visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment. To cancel services booked through third party vendors, please contact the applicable vendor.
8.3 It is recommended that you purchase trip cancellation insurance. Trip cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your trip for any reason, whether voluntarily or as a result of PARLOUR’s actions.
9. CANCELLATION OF TRAVEL/SERVICES BY PARLOUR
9.1 If a trip or any Services are cancelled by PARLOUR before the date of departure for reasons other than Force Majeure (as herein defined in Section 24) and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from PARLOUR:
(a) a substitute trip or Service of equivalent or superior value, where such substitute is reasonably available; or
(b) a substitute trip or Service of lesser value if no trip or Service of equivalent or superior value is reasonably available, and to recover from PARLOUR the difference in price between the price of the trip/Service originally purchased and the substitute trip/Service; or
(c) a full refund of all monies paid for the cancelled trip/Service if a substitute trip is not available.
9.2 PARLOUR reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a trip as described cannot be provided after departure, PARLOUR will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, PARLOUR may provide you with a refund for unused Services as determined in its sole discretion.
9.3 PARLOUR is not responsible for any incidental expenses or consequential losses that you may incur as a result of a booking it has cancelled such as visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment.
10. VALIDITY
All dates, itineraries and prices are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance these Terms. You acknowledge that you are responsible for keeping up to date on the specific details of your trip and any other Services, including, but not limited to checking the relevant PARLOUR-operated website at least 72 hours prior to departure as minor changes may have been made after the time of booking. It is also your responsibility to maintain an updated email address and to convey any changes in your email to PARLOUR.
11. AIRFARE
Trip prices do not include international or other airfare unless expressly mentioned in the trip’s description. PARLOUR is not responsible for changes in air itineraries or flight times and does not provide advice or alerts regarding air travel tickets, flight status or delays. You are responsible for consulting your preferred air carrier’s applicable terms and conditions, conditions of carriage, and cancellation terms.
12. UNUSED SERVICES
PARLOUR shall not offer or pay any discounts or refunds for missed or unused services which were missed or unused due to no fault of PARLOUR, which shall include any termination of your participation in the trip/Services due to your own fault, negligence or breach of these Terms.
13. TRAVEL DOCUMENTS
13.1 It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities (including but not limited to all visas, permits and certificates, vaccination or medical certificates, and insurance policies). You must have a passport that is valid 6 months after the last date of travel as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to commencement of travel, and you are solely responsible for the full costs incurred as a result of missing or defective documentation.
13.2 You agree that you are responsible for the full amount of any loss or expense incurred by PARLOUR that is a direct result of your failure to secure or be in possession of proper travel documentation. Any information or advice provided by PARLOUR regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, and PARLOUR is not responsible for any errors or omissions in this information or in the information provided by third parties such as government or travel authorities.
14. CHANGES
14.1 Itinerary/Trip Details. The itinerary, trip details, or suggested activities are provided as a general guide to the trip and region and any mention of specific destinations is not a guarantee that they will be visited or encountered, nor does it form part of the contract between you and PARLOUR.
14.2 Changes made by PARLOUR. While PARLOUR will endeavor to operate all Services as advertised, reasonable changes in the itinerary of any Service may be made where deemed necessary or advisable for operational reasons by PARLOUR, in its sole discretion. If PARLOUR makes a change affecting at least one in three full days of the itinerary or which materially affects the character of a Service in its entirety (a “Material Change”), PARLOUR will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure. If a Material Change is made more than 14 days before departure, you may choose to:
(a) accept the Material Change and proceed with the amended Service;
(b) book another Service of equal or greater value, if available (you will be responsible for paying any difference in price);
(c) book another Service of a lower value, if available (with a refund payable you for the difference in price; or
(d) cancel and receive a full refund (this shall not extend to additional Services booked which are not subject to any Material Change).
You must notify PARLOUR of your decision in writing within 7 days of receiving the notification of alteration, or you will have been deemed to accept the amended itinerary.
14.3 Post-Departure Changes. Once a trip has departed, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at PARLOUR’s sole discretion. You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with PARLOUR, whether or not such expenses arise from a change of itinerary, and that PARLOUR is not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise. PARLOUR will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary.
15. ACCEPTANCE OF RISK AND RESPONSIBILITIES
15.1 You acknowledge that the nature of travel and Services offered by PARLOUR may involve a significant amount of risk to your health and safety. By traveling with PARLOUR, you hereby assume responsibility for all such risk and release PARLOUR from any and all claims and causes of action arising from any losses, damages, injuries, or death resulting from risks inherent in travel, including visiting foreign destinations and participating in adventurous activities.
15.2 Accommodation, transportation, activities and excursions, and other components of the trip/Services may be arranged with suppliers and vendors local to the destination region, who may themselves engage the services of local operators and/or sub-contractors. The terms and conditions of all local suppliers or vendors will be applicable to the service they provide and are expressly incorporated into these Terms. PARLOUR’s liability will not exceed that of any local supplier or vendor. The services shall be regarded as having been satisfactorily performed and delivered solely in reference to the regulations and laws concerning health and safety in the applicable jurisdiction where such service is performed.
15.3 Standards of hygiene, accommodation and transport in certain countries where PARLOUR travels can be lower than the standards you may reasonably expect in your home country or region. You agree that PARLOUR is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a trip or Service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
15.4 You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply or commit any illegal act while traveling or, if in the opinion of PARLOUR (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, PARLOUR may terminate your travel arrangements on any Service immediately at your expense and without any liability on the part of PARLOUR. You will not be entitled to any refund for unused or missed Services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.
15.5 You are responsible for any costs (including repair, replacement and cleaning fees) incurred by PARLOUR or its suppliers for property damage, destruction, or theft caused by you. You agree to immediately report any pre-existing damage to staff of the accommodation, transportation service, or facility as soon as possible upon discovery.
15.6 You agree to take all prudent measures in relation to your own safety while traveling, including, but not limited to, the proper use of safety devices such as seatbelts, harnesses, and helmets, and obeying all posted signs and warnings. PARLOUR shall not be liable for your failure to comply with this section.
16. OPTIONAL EXTRAS
16.1 Optional Extras refers to any activity, transportation, meal, product or service not expressly included in the trip itinerary or price and do not form part of the official trip. You agree that any assistance provided by PARLOUR or its representative(s) in arranging, selecting, or booking, any Optional Extras is offered purely as a courtesy and PARLOUR makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras. You release PARLOUR from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.
16.2 You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury, or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party, providing that service or activity.
16.3 You release PARLOUR from all liability, claims, and causes of action arising from medical advice or procedures administered by any attending medical professionals associated with PARLOUR.
17. LIABILITY
17.1 PARLOUR and its parents, subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for any damages, expenses, losses, or claims which are attributable to the fault of any Client, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services that form any part of the Product(s), or a Force Majeure event (as herein defined in Section 24). YOU MUST COMMUNICATE, TO PARLOUR, AT THE EARLIEST OPPORTUNITY AND IN WRITING, ANY SUCH ALLEGED CLAIMS.
17.2 In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of PARLOUR or of the third-party suppliers of any services which form part of the booking agreement, then PARLOUR limits its liability to a maximum of the price which paid for the trip or Service, not including insurance premiums and administration charges, subject to all applicable international conventions.
17.3 PARLOUR will not at any time be liable for any loss, theft, or damage to valuables and personal possessions of any nature, including luggage. You are responsible at all times for your own belongings. PARLOUR cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used during travel such as hotels, vessels, expedition vehicles, or any other mode of transportation.
18. IMAGES AND PROMOTIONAL MATERIALS
You agree that, while participating in any PARLOUR trip, photos or videos (“images”) may be taken by other participants, PARLOUR or its representatives that may include or feature you and your likeness. You consent to any such images being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to PARLOUR, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
19. INSURANCE
PARLOUR recommends that you obtain travel insurance with a minimum medical, evacuation, and repatriation coverage of USD$200,000 covering all applicable dates of any travel. A policy should at minimum cover personal injury and emergency medical expenses, and it is strongly recommended that you extend coverage to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience. You acknowledge that the cost of the trip and Services do not include any personal insurance coverage for you or your belongings.
20. CLAIMS AND COMPLAINTS
You agree to bring any complaints to PARLOUR’s attention as soon as possible in order to provide the PARLOUR with the opportunity to properly address such complaint. PARLOUR assumes no liability for complaints that are not properly brought to its attention and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a trip must be received in writing by PARLOUR within 30 days of the last day of travel of the booking in question. You acknowledge and agree that PARLOUR is not obligated to remedy or accept any liability for claims received after this period.
21. REFUSAL OF SERVICE
PARLOUR reserves the right to refuse service to any person at any time, for any lawful reason whatsoever, in its sole discretion.
22. PRIVACY POLICY
PARLOUR must collect your personal information to plan and deliver the trip and any Services. PARLOUR takes care to safeguard all Client information and protect your privacy. PARLOUR collects, uses, and discloses only that information reasonably required to enable it and its suppliers/vendors to provide the particular trip and Services that you have booked, to maintain our contact lists, and to respond to inquiries or feedback as described in PARLOUR’s Privacy Policy, which can be accessed any time at http://parlourmagazine.com/privacy-policy/ and is expressly incorporated into these Terms. By submitting any personal information to PARLOUR, you indicate your acceptance of its Privacy Policy.
23. ONLINE BOOKINGS
All online bookings/reservations shall be deemed as being made in the United States of America, and shall be subject to the laws and jurisdiction of the United States.
24. FORCE MAJEURE
PARLOUR will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both directly and indirectly incurred, or for PARLOUR’s failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by an Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of PARLOUR; or an event which PARLOUR or its suppliers/vendors, even with all due care, could not foresee.
25. SEVERABILITY
If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.
26. CONTRACT PARTIES, SUCCESSORS AND ASSIGNS
These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors and assigns.
27. APPLICABLE LAW
These Terms and the interpretation thereof shall be governed exclusively by the laws of the State of New York, without reference to its choice of law provisions. You submit to the exclusive jurisdiction of the courts located in New York for the resolution of any dispute under these Terms or concerning a trip or Service offered hereunder.
28. WAIVERS
The failure of any party to seek redress for violation of or to insist upon the strict performance of any covenant or condition of these Terms shall not prevent a subsequent act, which would have originally constituted a violation, from having the effect of an original violation.
29. AMENDMENTS
PARLOUR reserves the right to update or alter these Terms at any time, and will post the amended Terms on its travel website(s). Any amendment will take effect 10 consecutive days after being posted. You are deemed to have accepted any amendments to these Terms on the date that is 10 consecutive days after their posting. PARLOUR recommends that you refer to the Terms prior to travel to familiarize yourself with the most up-to-date version available.
30. ENTIRE AGREEMENT
These Terms constitute the entire Agreement between you and PARLOUR with respect to the subject matter thereof and supersedes all prior agreements, representations and understandings of the parties, written or oral.
